The Supreme Court on Friday upheld the declaration of Sir Frank Ibezim as the All Progressives Congress senatorial candidate for Imo North.
It dismissed an appeal filed by Senator Ifeanyi Ararume challenging the decision of the Court of Appeal’s quashing of the judgment of a Federal High Court on the matter.
The Federal High Court had made consequential orders directing the Independent National Electoral Commission to replace Ibezim with Ararume as the APCs candidate.
In a unanimous decision, the apex court said the Federal High Court ought not to have made the consequential orders against Ibezim.
In the lead and concurrent judgements read by Justice Mohammed Lawal Garba and Justice Emmanuel Akomaye Agim, the apex court declared that since Ibezim was not a party or privy to the matter at the high court, his fundamental human rights had been abridged.
The court also said it was wrong for the high court not to have dismissed TLA suit filed by Lady Uchenna Mbah as lacking in merit.
