Court vacates order on seizure of senator’s assets



A Federal High Court in Abuja on Monday reversed the seizure of assets and bank accounts belonging to the senator representing Delta North, Peter Nwaboshi.

Justice Taiwo Taiwo had on July 5, 2019 granted an interim forfeiture order sought by Special Presidential Panel on the Recovery of Public Property to seize the Peoples Democratic Party senator’s assets.

He gave the senator 30 days to show cause why the assets should not be permanently forfeited to the Federal Government.

The senator’s lawyer, Robert Clarke (SAN), had filed a Motion on Notice on July 11 asking the court to vacate the order.

The motion sought “An order setting aside and/or annulling, ex-debito justitiae (as a matter of right) the interim forfeiture and restraining orders made in this suit on the 2nd July, 2019 suit by this honourable court pursuant to the amended motion ex-parte dated the 22nd November, 2018.

“An order indemnifying the applicant by the complainant/ respondent to the full extent of the loss and damages suffered by the applicant by reason of the said ex-parte interim forfeiture and restraining orders from the 6th July, 2019 in the sum of N50million.”

The court on Monday granted the request and returned the assets to their owner.
